Did You Know...As the use of temporary employees increases, so do the citations against employers as the result of injuries to these temporary employees. The largest portion of the penalties are resulting from the company's failure to train temporary employees about safety procedures and practices. These citations can carry a minimum penalty of $7000 per program. How This Effects You...Employers should not assume that the temporary employee has been trained by the employment agency or that the employee has previous experience with the work you are assigning them. A recent study revealed that temporary employees were 9 times more likely to be injured than permanent employees. |

OSHA issues two primary types of citations. The type of violation will partially determine the amount of the fine assessed. The citation types and their definitions are as follows:
Willful Violation: either an intentional violation of the act or plain indifference to its requirements, and is one in which an employer knew that a condition constituted a violation or was aware that a hazardous condition existed and made no reasonable effort to correct it. The fine for a Willful Violation may start at $75,000 and up.
Serious Violation: one in which there is substantial probability that death or serious physical harm could result from the hazardous condition, and the employer knew or should have known of the haxardous condition.
