26 Steps to a Successful OSHA Inspection
- Select a company representative to meet with the OSHA Compliance
Officer (C.O.).
- Be polite; inspect credentials; ask why.
- Ask for a warrant if it is company policy to do so.
- If there is a warrant it will state time limits and ground rules
- "Who are here for what" agreement.
- Discuss ground rules with the C.O.
- Treat C.O. with respect but remember they are your guest.
- Do not get too friendly.
- Opening conference takes about an hour.
- The C.O. will ask for records. You have the right to ask why and
refuse if not relevant.
- Stay with the inspector at all times.
- Don't admit guilt!!!
- Be aware of what the C.O. takes notes on.
- The C.O. cannot give employees orders.
- The C.O. may point out what are believed to be violations. Never
agree that a standard has been violated.
- Do not engage in idle chit-chat.
- Do not hesitate to disagree. OSHA is not a building code.
- Few OSHA inspectors are experts on OSHA requirements!!
- Do not conduct demonstrations for OSHA's benefit.
- Employee interviews must not interfere with work.
- Employees do not have to participate in interviews or tests if they
object.
- Never give estimates.
- Be present during all management interviews (as a group).
- Make note of everything that happens. Take pictures and tests when
they do.
- Ask the C.O. questions and record answers.
- Recap and detail dates, names, times, notes, pictures and recordings.
- Ask to record the meeting!!!!
